A freelance content writer contract in India should set the number of pieces and word counts, how briefs are agreed, revision rounds, originality and AI-use terms, whether you get a byline, and when the copyright passes to the client. Writers own their work until it is assigned in writing, so tie the transfer to payment and agree publishing rights up front.

A content writer contract is a services agreement between a freelance writer and a client that fixes the pieces to be written, word counts, briefs, revisions, deadlines, payment and who owns the finished work. In India it is governed by the Indian Contract Act, 1872, and can be signed electronically.
Writing disputes usually involve shifting briefs, rewrites and who gets credit. These clauses settle them.
| Clause | What to write | Why it matters |
|---|---|---|
| Deliverables | Number of pieces and approximate word count | Sets the size of the job |
| Briefs | Topic and keywords agreed in writing before each piece | A changed brief is new work, not a revision |
| Revisions | Rounds included per piece, and the rate after | Prevents unlimited rewrites |
| Originality | Work is original and not copied | Clients need this for search and legal reasons |
| AI use | Whether AI tools may be used, and how disclosed | Increasingly asked for by clients |
| Byline | Ghostwritten, or credited to the writer | Avoids disputes over credit |
| Copyright | Assigned to the client on full payment | The writer owns the work until assigned in writing |
| Payment | Per piece or per word, with due dates | Clear basis for each invoice |
The writer, until the copyright is assigned. An article is a literary work under the Copyright Act, 1957, and Section 17 makes the author the first owner. Ownership passes to the client through a written, signed assignment under Section 19.
Even after assignment, Section 57 keeps the author's right to claim authorship and to object to distortion that harms their reputation. If the work is ghostwritten, say clearly that the client may publish it under its own name. See who owns freelance work.
Settle these points before the first draft.
Charge per piece for predictable formats and per word for variable lengths, with a minimum per piece. For ongoing work, a monthly retainer for a fixed number of pieces, billed in advance, protects you from slow payers.
Expect Indian business clients to deduct TDS on professional fees once payments cross the annual threshold, and say in the contract that payment is net of any statutory deduction.
These are the most common gaps in writing agreements.
On Defellix you can start from a ready-made content writer template with the briefs, revisions, originality, byline and ownership clauses written in, then replace the bracketed details. Your client signs by email OTP, and every submission and approval is recorded with a timestamp. Your first contract is free.
Only if the contract assigns the copyright. Payment alone usually gives a right to use the article, so write the assignment into the contract and tie it to full payment.
Only with the client's permission. Ghostwriting arrangements often keep the writer anonymous, so agree portfolio use in the contract.
No. A revision improves the agreed piece. A new or changed topic is new work and should be quoted separately.
It helps to. Many clients now ask whether AI tools were used, so state what is allowed and how it will be disclosed.
